Every divorce has two parts. The first and hardest part is coming to a negotiated settlement on all issues. The second part is actually going to court, taking an oath, and asking the court to grant you a full and legal divorce. In New Jersey, one person from the couple must be the Plaintiff, file a Complaint for Divorce and go to the court for the final hearing. The other party, the Defendant, isn’t required to attend court if a default judgment has been entered. Most attorneys, however, prefer that both spouses attend the final hearing in case any last minute questions come up and because going to Court brings clients closure.
