The collaborative participation agreement is a contract entered into between two parties and their respective collaborative counsel. The agreement, in brief, sets forth that the parties agree not to run to court while in the collaborative process, to offer and share full and honest personal and financial disclosure and to work together with their collaborative team members to tailor the best possible resolution of their divorce. If either party violates the terms of the agreement or decides to go to litigation, the agreement requires the collaborative lawyers to withdraw from the case.
