Initial Interviews Are a Two Way Street

June 17, 2013

Interviewing a Divorce Lawyer is a Two Way Street -Highlights of an Initial Consultation: When contemplating the merits and pitfalls of getting a divorce, most clients contact an attorney to get information about divorces in general and, hopefully, some personal guidance on how, if and when to proceed. I’ll bet though that most people don’t […]

How Is Getting Divorced Like Making a Cake?

May 6, 2013

As some of you may know, I am a prolific and creative baker. I just love to make from scratch all kinds of pies, cakes, exotic icings, yeast breads, fruit strudels, obscenely delicious brownies, cupcakes galore and more varieties of cookies than Rachel Ray has recipes for chicken. The secret of baking is to follow […]

What if a person loses their job, or if the amount of their pay is reduced, does this guarantee that child support will be reduced?

April 26, 2013

A decrease in available income is not a guarantee that the support obligation will be decreased. In order to justify a downward modification of child support, the decrease in income must be permanent in nature. The support payor must be able to prove that after numerous attempts, that he could not find a decent paying […]

“Oh Deer! ” Pay Attention to the World Around You

March 8, 2013

As some of you know, about two years ago, I was driving west by Intermediate School around dusk on West Park Avenue in my little convertible when I saw a large deer cross the road just at the edge of my headlights.   Having grown up in upstate New York, I remembered the old adage, […]

When does child support terminate?

March 5, 2013

A child support order will terminate once the child becomes emancipated. Emancipation basically means that the child can take care of themselves. Because self-reliance can occur at any age and under any given set of facts, there is no set age when a child will be determined to be emancipated. Many people erroneously believe that […]

Who should pay for the cost of college?

February 11, 2013

In most circumstances, the privilege of parenthood carries with it the duty to assure that the child receives a good college education. Our courts have held that, in general, financially capable parents should contribute to the higher education of children who are qualified students. In evaluating a party’s obligation for contribution toward the cost of higher education, […]

What is child support?

November 5, 2012

Every child is entitled to support from his parents. The New Jersey child support guidelines are based on the theory that child support is determined in proportion to the parent’s income and assets as well as the child’s needs. All parents, whether natural or adoptive, have a financial obligation to support their child. This obligation continues even […]

How is Collaborative Divorce different from the traditional adversarial divorce process?

October 4, 2012

• In Collaborative Divorce, there is an open, honest exchange of information. Neither party takes advantage of the miscalculations nor mistakes of the others, but instead identifies and corrects them. • In Collaborative Divorce, both parties insulate their children from their disputes and, should custody be an issue, they avoid the professional custody evaluation process. […]

INTERESTS VERSUS POSITIONS

Is a collaborative divorce faster than a traditional divorce?

September 12, 2012

Normally, yes. Where there is a consensual, no-fault divorce, where the parties are actively working to reach an agreement, the process will be much shorter than when you’re waiting for court dates, and the like. Again, in collaborative, you control the timing and the progress, as opposed to being controlled by a court schedule.
